Tract 2:

Approximately 47+/- cropland acres of which a small portion is used as pasture. The balance is mostly wooded and there is a small pond. This is also a must see tract. This tract has recreational and hunting opportunities with income potential from the tillable acreage. Also be sure to investigate the potential timber income. There is a wooden foot bridge over the creek which crosses this tract; however the buyer is responsible for gaining access over the creek with equipment, whether it be a drive through, bridge or culvert crossing. PROCEDURE: The property will be offered in 3 individual tracts, any combination of tracts, and as a total 115+/- acre unit. There will be open bidding on all tracts and combinations during the auction as determined by the Auctioneer. Bids on tracts, tract combinations, and the total property may compete.
DOWN PAYMENT: 10% down payment on the day of auction for individual tracts or combinations of tracts. The down payment may be made in the form of cashiers check, personal check, or corporate check. YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING, so be sure you have arranged financing, if needed, and are capable of paying cash at closing.
ACCEPTANCE OF BID PRICES: All final bid prices are subject to the Sellers acceptance or rejection. All successful bidders will be required to sign Purchase Agreements at the auction site immediately following the close of the auction.
DEED: Seller shall provide a Warranty Deed sufficient to convey insurable title to the real estate. Real estate is sold subject to all rights of way, legal highways, leases, easements of public record, and all other matters of public record.
EVIDENCE OF TITLE: Seller shall provide a preliminary title insurance commitment for review prior to auction. Seller agrees to furnish Buyer(s), at Sellers expense, an updated title commitment prior to closing. The cost of providing an Owners Title Policy shall be paid for by Seller at closing.
HAY CROP AND BUILDING RENT: Seller to receive Owners share (50%) of hay income from the 1st two cuttings in 2015. Buyer to receive Owners share of hay crop thereafter respective to the Tract purchased. Seller will pay the buyer of Tract 3, $2,000/month, at the end of each month from the time of closing until possession is delivered, for rent on the buildings and building lot.
CLOSING: The balance of the purchase price is due at closing, which will take place 30 days after auction day, or as soon thereafter as applicable closing documents are completed by the Seller. Costs for an administered closing shall be shared 50:50 between Buyer(s) and Seller. All lender costs shall be paid by the Buyer(s).
POSSESSION: Possession of the wooded land and hay land is at closing, subject to the tenants rights for the 2015 growing hay crop. Possession of the 2 homes, outbuildings and building lot is December 1, 2015. Possession of pasture on Tract 2 is at closing. Possession of vegetable plot on Tracts 2 and 3 after Sellers 2015 crop harvested.
REAL ESTATE TAXES: Seller shall pay the real estate taxes for the first part of the calendar year in which the closing occurs, prorated to the date of closing. Buyer shall assume any taxes thereafter. Buyer shall assume any ditch and drainage assessments due after closing.
ACREAGE: All tract acreages, dimensions, and proposed boundaries are approximate and have been estimated based on aerial photos.
SURVEY: The Seller shall provide a new survey where there is no existing legal description or where new boundaries are created by the tract divisions in this auction or where Seller otherwise determines a survey is appropriate. Any need for a new survey shall be determined solely by the Seller. Seller and successful bidder shall each pay half (50:50) of the cost of the survey. The type of survey performed shall be at the Sellers option and sufficient for providing title insurance. If Seller determines a survey is needed, combined purchases will receive a perimeter survey only. Final sales price shall be adjusted to reflect any difference between advertised and surveyed acres, except with respect to Tract 3 or any combination which includes Tract 3.
NOTE: The following items do not stay and will be removed by the Seller prior to delivering possession: Chicken coop, mini barn, hoop greenhouse, school house, all solar panels and associated equipment. In the north house: cabinets in pantry, 1 set of cabinets on the south porch, kitchen cabinets on the north wall, water softener, LP gas heaters and wood stove. In the south house: the wood stove. In the shop: the hydraulic pipe, filters for air lines (white lines stay), LP lines and the 2 wood stoves.
PLANNING APPROVAL: The sale of all tracts is subject to any governmental planning approval or other necessary governmental approval. The real estate is being offered for agricultural purposes, and any construction on the property may require governmental approval.
PROPERTY INSPECTION: Each potential Bidder is responsible for conducting, at their own risk, their own independent inspections, investigations, inquiries and due diligence concerning the property. Inspection dates have been scheduled and will be staffed with auction personnel. Further, Seller disclaims any and all responsibility for Bidders safety during any physical inspection of the property. No party shall be deemed an invitee of the property by virtue of the offering of the property for sale.
