Tract 3: 56.5+/- acres of mostly tillable land with Cyclone, Miami Crosby, Starks & Fincastle soils. Road frontage along the western edge of tract on CR800E.
Tract 4: 65.5+/- acres of tillable land with Cyclone, Fincastle-Crosby & Starks soils. Road frontage along the eastern edge of tract on CR800E.

AUCTION TERMS & CONDITIONS:

PROCEDURE: The property will be offered in 5 individual tracts, any combination of tracts and as a total 212+/- acre unit. There will be open bidding on all tracts and combinations of tracts during the auction as determined by the Auctioneer. The property will be sold in the manner resulting in the highest total selling price.
DOWN PAYMENT: 10% down payment on the day of auction for individual tracts or combinations of tracts. The down payment may be made in the form of cash, cashier's check, personal check, or corporate check. YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING, so be sure you have arranged financing, if needed, and are capable of paying cash at closing.
ACCEPTANCE OF BID PRICES: All successful bidders will be required to enter into Purchase Agreements at the auction site immediately following the close of the auction. All final bid prices are subject to the Sellers' acceptance or rejection.
EVIDENCE OF TITLE: Seller shall provide an owner's title insurance policy in the amount of the purchase price.
DEED: Seller will convey with Warranty Deed(s).
CLOSING: Closing shall take place 30 days after the day of the auction, or as soon thereafter as applicable closing documents are completed by Seller.
POSSESSION: Possession is at closing subject to the tenants rights to harvest the 2009 crop.
REAL ESTATE TAXES: Seller shall pay all 2009 taxes due 2010. Buyer shall assume 2010 taxes due in 2011.
ACREAGE: All tract acreages, dimensions, and proposed boundaries are approximate and have been estimated based on current legal descriptions and/or aerial photos.
SURVEY: The Seller shall provide a new survey where there is no existing legal description or where new boundaries are created by the tract divisions in this auction. Solely the Seller shall determine the need for a new survey. Seller and successful bidder shall each pay half (50:50) of the cost of the survey. Combination purchases will receive a perimeter survey only. Closing prices shall be adjusted to reflect any difference between advertised and surveyed acres, if a new survey is determined to be necessary by the seller.
