PROPERTY LOCATION:From Rochester, IN, take SR 25 4 miles south to CR 400S, then go approximately 10 miles west on 400S to CR 1000W, then go 1/4 mile south on 1000W to property on west side of the road.
AUCTION LOCATION:From Rochester, take SR 25 on the southside of Rochester to Alejandras Family Restaurant.
PROPERTY DESCRIPTION:
Tract 1: This 42.5± acre tract has approximately 90ft of frontage on CR 1000W. It is all tillable and has quality soils. Note: This tract will give a 60ft easement for ingress and egress back to Tract 2.
Tract 2: A 40± acre field which is mostly all tillable and also has quality soils.
Tract 3: A 40± acre swing tract (which means it must be purchased by an adjacent landowner or in combination with Tract 2) is mostly all tillable and has quality soils. Note: There may be part of this tract that may lay south of Mill Creek.
Tract 4: A 1995 Zimmatic 7 tower center pivot with 4652 hours. This center pivot will irrigate approximately 107ᄆ acres of the 120 acres with this tract. There is approximately 1855ft of 8 underground pipe and 1380ft of 12/2 underground wire from CR 1000W. Also included is the main pump, pipe from the Mill Creek and (2) control panels. This tract may be purchased separately and removed or it may be purchased with Tracts 1, 2 and 3. Note: There is an easement for ingress and egress back to the irrigation system.
Note: Mr. Jerry Brown stated to me that he is the adjacent landowner to the east and he will allow that if Tract 4 buyer purchases Tracts 1, 2 and 3, he will allow the buyer ingress/egress easement along the ditch bank back to the pump for repairs, maintenance and operation of irrigation pump.
Real Estate Taxes: 2008-2009 - $9/acre (only an estimate) Estimated by the Treasurer. Ditch Tax - $244.86
Note: Tracts 1, 2 & 3 will fall under the agriculture split exemption rule, which means restriction on the placement of structures.
Mr. William Plummer stated that 70 acres will be eligible for potatoes in 2011. Also, he may or may not use part of this sale for a 1031 Exchange.
Per William Plummer, 2007 corn averaged over 206 bu., 2008 soybeans averaged 49 bu., and for 2009 corn is over 200 bu. under the irrigator.
AUCTION TERMS & CONDITIONS:
PROCEDURE: Tracts 1 - 4 will be offered in individual tracts, and in any combination of these tracts, or as a total unit. There will be open bidding on all tracts and combinations during the auction as determined by the Auctioneer. The property will e bid on in the manner resulting in the highest total sale price.
DOWN PAYMENT: 10% of the accepted bid as down payment on the day of auction with balance in cash at closing. The down payment may be made in the form of cashiers check, personal check, or corporate check. YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING, so be sure you have arranged financing, if needed, and are capable of paying cash at closing.
APPROVAL OF BID PRICES: All successful bidders will be required to enter into Purchase Agreements at the auction site immediately following the close of the auction. All final bid prices are subject to the Sellers acceptance or rejection.
DEED: Seller shall provide a Warranty Deed.
EVIDENCE OF TITLE: Seller shall provide title insurance in the amount of the purchase price.
CLOSING: Closing shall take place 15 days of merchantable title.
POSSESSION: At closing.
REAL ESTATE TAXES: Buyer(s) will pay the 2010 real estate taxes payable 2011 and thereafter.
DITCH ASSESSMENTS: Buyer shall pay all ditch assessments due after closing.
ACREAGE: All acreage is approximate and have been estimated based on current legal descriptions and/or aerial photos.
SURVEY: Any need for a new survey shall be determined solely by the Seller, as there is an existing perimeter survey. Cost of any new survey will be split 50/50 between Buyer and Seller. Tracts bid in combinations shall receive a perimeter survey only. There shall be no adjustment if the results of a new survey differ from advertised acres.
EASEMENTS: The sale of the property is subject to any and all easements of record.
