TRACT DESCRIPTIONS
Tract 1: 16± ac ALL TILLABLE CROPLAND! There is over 700 feet of road frontage. Soil type is mostly Blount Loam with some Glynwood and Pewamo mixed. This tract lies level and runs behind the existing buildings.
Tract 2: 12± ac MOSTLY TILLABLE CROPLAND! There is over 600 feet of road frontage along this tract. The entire road frontage, however, is bordered by an open ditch. There would need to be a bridge to access this tract. This tract offers a gorgeous elevated potential building site with walk-out potential. There is a small part of woods on the back. Combine this tract with Tract 1 for 28 acres of productive crop land!
Tract 3: 5± ac This tract has over 500 feet of frontage along S. R. 49 and over 700 feet of frontage along Williams - Defiance County Line Road. This tract lies level and is mostly Blount loam soils. It is currently in hay and would offer a great potential corner building site!

AUCTION TERMS & CONDITIONS
PROCEDURE: The property will be offered in 3 tracts and in combination. There will be open bidding on all tracts and the combination of tracts during the auction as determined by the Auctioneer.
DOWN PAYMENT: 10% down payment on the day of auction with the balance in cash at closing. The down payment may be made in the form of cash, cashier’s check, personal check or corporate check. Your bidding is not conditional upon financing, so be sure you have arranged financing, if needed, and are capable of paying cash at closing.
ACCEPTANCE OF BID PRICES: All successful bidders will be required to enter into purchase agreements at the auctions site immediately following the close of the auction. Sale is subject to the Sellers’ approval.
DEED: Seller shall provide a Warranty Deed.
CLOSING: The balance of the purchase price is due at closing, which will take place within 15 days of presentation of insurable title. Costs for an insured closing shall be shared 50:50 between Buyer(s) and Seller.
POSSESSION: Possession shall be on the day of closing, immediately following the closing, subject to Tenant Farmer’s current soybean crop.
REAL ESTATE TAXES: The Seller shall pay all of the 2010 Real Estate taxes due in 2011. The Buyer(s) shall assume and pay all taxes thereafter.
ACREAGE: All tract acreage, dimensions and proposed boundaries are approximate and have been estimated based on current legal descriptions and/or aerial photos.
SURVEY: The Seller shall provide a new survey where there is no existing legal description or where the tract divisions in this auction create new boundaries. Solely the Seller shall determine any need for a new survey. Seller and successful bidder shall each pay half (50:50) of the cost of the survey. The type of survey performed shall be at the Seller’s option and sufficient for providing title insurance. .
