PROCEDURE: The property will be offered in one, 24± acre tract using open bidding. The property will be sold to the highest bidder, subject to the confirmation of the seller.

DOWN PAYMENT: 10% down payment on the day of auction is required in the form of cash, cashier’s check, personal check, or corporate check. YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING, so be sure you have arranged financing, if needed, and are capable of paying cash at closing.

ACCEPTANCE OF BIDS: All successful bidders will be required to enter into Purchase Agreements at the auction site immediately following the close of the auction. All final bid prices are subject to the Sellers’ acceptance or rejection.

EVIDENCE OF TITLE: The Seller agrees to furnish bidders a preliminary opinion of title to review if Buyer(s) elect to purchase title insurance at their own expense. Seller agrees to provide merchantable title to the property subject to matters of record, general conditions and title and similar or realted matters. All tracts are sold “AS IS.”

DEED: Seller shall provide appropriate Deed(s). Real Estate sold subject to all rights of way, legal highways, leases and easements of public record.

CLOSING: Closing shall take place 45 days after auction day, or as soon thereafter as applicable closing documents are completed.

POSSESSION: Possession at closing, subject to currant tenant’s 2010 corn crop removal.

REAL ESTATE TAXES: 2011 taxes due in 2012 and thereafter real estate taxes will be the responsibility of the Buyer(s). Property is currently in residential use and to apply for any CAUV, Buyer(s) must contact the Union County Auditor’s Office and file after the first Monday of January and prior to the first Monday in March in any year.

ACREAGE: All acreage, dimensions, and proposed boundaries are approximate and have been estimated based on current legal descriptions and/or aerial photos.

SURVEY: Any need for a new survey shall be determined solely by the Seller. Seller and successful bidder shall each pay half (50:50) of the cost of the survey. The type of survey shall be at the Seller’s option and sufficient for providing title insurance. Closing prices shall be adjusted to reflect any difference between advertised and surveyed acres if new survey is determined to be necessary by the Seller. All parcels are subject to county and township Planning and Zoning Commission regulations.

PROPERTY INSPECTION: Each potential Bidder is responsible for conduction, at their own risk, their own independent inspections, investigations, inquiries and due diligence concerning the property. Inspections dates have been scheduled and will staffed with auction personnel.
